GATE Waiver of Liability

PLAIN LANGUAGE SECTION

The intent and meaning of this waiver is simple: to restrict the rights of GATE Village Members from pursuing legal remedies to internal GATE Village actions, activities, processes, and/or procedures.

WHY THIS WAIVER IS NECESSARY

There are really two ways to fly: 1) closed and guarded with constant “liability, libel, and slander concerns” making communication difficult and leading to a lack of trust; or 2) open, transparent, honest and free-flowing in information exchange making communication easy but also leaving one open to 'saying the wrong thing'. GATE Village chooses number 2).

GATE TRUST RATINGS COULD BE LIBELLOUS BUT MEMBERS ARE PROTECTED

Knowing that “where there is trust, ideas flow and people do what people do best: collaborate, invent, discover, and learn together”, GATE Village fosters a community of Trust and, through the GATE Trust System of RANKING and RATING, ensures that Trust is visible and while all Trust RATINGS are open for the Membership to review, all are also subject to the GATE Confidentiality and Ethics Policy (“what happens in GATE Village stays in GATE Village”). It seems inevitable, however, that there will be conflicts between Members, where one Member may make a comment in a Trust RATING that another Member doesn't like – GATE Village provides the GATE Trust Investigation Procedure as the sole remedy available to all Members for addressing such concerns.

GATE VILLAGE PROVIDES FREE SPEECH

GATE Village believes in free speech and has no intention of curbing the thoughts or expressions of Members, GATE Management believes that the transparency in the Trust RATINGS along with the lack of anonymity will lead to civilized public discourse and thus does not intend to restrict speech in any fashion. GATE Members are reminded that they put their own reputation on the line with every word they type/write/speak and should judge their own actions accordingly.

LEGAL COSTS COULD DOMINATE IF NOT CONTROLLED

LIBEL and/or SLANDER is not possible in GATE Village

To ensure that the GATE Access Fees remain low and the payback to the membership is maximized, it is necessary to avoid costly legal battles. Thus, by joining GATE Village, GATE Members all agree to waive any and all rights to pursue legal remedies for libellous or slanderous statements MADE INSIDE GATE VILLAGE by any other GATE Member, or GATE Employee.

SPECIFIC WAIVER OF LIABILITY FOR GATE SUPPLIES

GATE Supplies are information objects created or commissioned by GATE for the exclusive use of GATE Village Members. Most GATE Supplies are provided on an “as-is” basis; Members may use the Information Object but GATE does not offer any guarantee that the Information Object is legally binding. All GATE Members specifically waive all liabilities rights in regards to GATE Supplies.

EXCEPTION MADE FOR VETTED GATE SUPPLIES

Some GATE Supplies are put through a legal vetting process using lawyers working for or on behalf of GATE Village. These GATE Supplies are clearly marked as “VETTED by GATE”; GATE Members who can show that any collateral so marked fails to meet the legal standards in place at the time of publication is free to pursue their concerns according to the RIGHT TO ARBITRATION section.

RIGHT TO ARBITRATION

In the event that a GATE Member wishes to pursue external means as per the previous section (EXCEPTION MADE FOR VETTED GATE SUPPLIES), the Member agrees to use the arbitration process <use standard language> and treat such arbitration as final and absolute. This assures that there is no long-running legal battle that serves nothing but making lawyers rich.
